Sebelius, No. 11-cv-17 (D.VT.)) and its implications for Medicare beneficiaries today. For more than thirty years, the wrongful interpretation of the Medicare statue has led to the illegal denial of care for tens of thousands of Medicare beneficiaries on the grounds that the individual's condition is stable, chronic, not improving, or only requires "maintenance care."

The lawsuit asserted that the "Improvement Standard" violates requirements of the Medicare statue and regularly causes harm to its beneficiaries.The majority of Medicare beneficiaries have at least two chronic conditions and may face such Medicare denials for the skilled treatment they require to maintain their conditions, improve quality of life and to keep their diseases in stasis. Today's announcement is expected to affect the lives of tens of thousands of Americans with long-term and chronic conditions.
